1. PURPOSE OF THE APP

Wherein-Oman is designed to provide Users with a digital platform to discover and explore:

• Local vendors and businesses
• Service providers
• Promotions and offers
• Business profiles and listings
• Contact information, locations, and redirections
• Other content and services made available within the App from time to time

The App is primarily an information discovery and listing platform and may include links or redirects to third-party sites, calling options, or other services.

2. ELIGIBILITY

By using the App, You confirm that:

• You are legally capable of entering into this Agreement under applicable laws; and
• You are at least 18 years old, or You are using the App under supervision/consent of a parent/guardian.

We do not knowingly collect personal information from children where prohibited by law.

3. ACCEPTANCE OF TERMS

This Agreement applies to:

• All users who browse the App without registering ("Guest Users")
• All users who register ("Registered Users")
• Users who access vendor/service provider features
• Users who submit content, reviews, or feedback

We may modify this Agreement at any time. Updated versions will be available within the App and/or at our website. Continued usage after modifications means You accept the revised Agreement.

4. LICENSE TO USE

Subject to compliance with this Agreement, We grant You a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the App for personal and lawful purposes only.

You may not:

• Rent, lease, sell, resell, distribute, or sublicense the App
• Copy or reproduce the App or any part of it
• Reverse engineer, decompile, disassemble, or attempt to extract source code
• Modify, adapt, create derivative works, or exploit the App or content commercially
• Use automated tools (scrapers, bots) to access or extract data
• Interfere with the security or integrity of the App

Any unauthorized use may violate laws and may result in termination.

5. APP FEATURES & THIRD-PARTY SERVICES

The App may provide:

• Listings of third-party vendors/service providers ("Third Party Providers")
• Maps and location features (e.g., Google Maps or Apple Maps)
• Click-to-call, WhatsApp links, website links, booking links
• Social media redirections
• Promotional banners, advertisements, sponsored listings

Important: We do not guarantee that any Third Party Provider will provide services, deliver products, honor pricing, provide refunds, or meet expectations. Any transaction or interaction is strictly between You and the Third Party Provider.

6. USER ACCOUNTS & REGISTRATION

Certain features may require registration. When You register, You agree to:

• Provide true, accurate and complete information
• Maintain the confidentiality of login credentials
• Notify us immediately if you suspect unauthorized access
• Accept responsibility for all activity under your account

We may suspend, restrict, or terminate accounts if we believe there is misuse, fraud, abuse, or policy violations, there is a security risk, or the account violates laws or third-party rights.

7. USER CONTENT (REVIEWS, FEEDBACK, IMAGES, LISTINGS, ETC.)

You may be able to submit content such as reviews, ratings, comments, photos or descriptions (if enabled), feedback, suggestions, complaints.

You agree that Your submitted content must not:

• Be false, misleading, or defamatory
• Include hate speech, violence, harassment, threats, or illegal content
• Contain copyrighted material without permission
• Contain viruses, malware, or harmful code
• Violate the privacy rights of others

We reserve the right to remove or restrict any content without notice. By submitting content, You grant Us a worldwide, royalty-free license to use, display, reproduce, adapt, or publish Your content solely for App operations, improvement, and promotional display within the platform.

8. ACCEPTABLE USE POLICY

You must not use the App for:

• Any unlawful activity
• Fraud, impersonation, or misrepresentation
• Attempting unauthorized access to systems
• Uploading malicious software
• Spamming, phishing, or abusive behavior

We may take legal action and/or report violations to authorities where required.

9. LOCATION SERVICES

If You enable location access, the App may use your location to show nearby vendors/service providers and improve search relevance and user experience.

You can enable/disable location permissions anytime in your device settings. Disabling location may limit some features.

10. ADVERTISEMENTS & SPONSORED CONTENT

The App may display App Provider promotions, third-party advertising banners, and sponsored listings/featured vendors.

We do not guarantee the accuracy, availability, or reliability of third-party advertisements. Any disputes from purchases or services are between You and the advertiser/vendor.

11. INTELLECTUAL PROPERTY

All rights, title, and interest in the App belong to the App Provider or its licensors, including:

• App name, logo, branding
• UI/UX design, layout
• Software code, databases, content structure
• Text, graphics, images created by App Provider

You do not obtain any ownership rights by using the App.

12. DATA COLLECTION & PRIVACY

We may collect technical and usage data, including device type, OS version, app performance logs, anonymous analytics and crash reports, browsing behavior within the App, approximate location (if enabled), and account details (if registered).

13. DISCLAIMER OF WARRANTIES

The App is provided on an "AS IS" and "AS AVAILABLE" basis.

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, and uninterrupted or error-free operation.

We do not guarantee vendor availability, offer validity, service quality by third parties, or uninterrupted access to the App.

14. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, goodwill, business, or data.
• We shall not be liable for issues caused by third-party vendors/service providers, including cancellations, delays, poor service, pricing disputes, or refunds.
• Our total cumulative liability under this Agreement shall not exceed US$10 or the equivalent in local currency.

This limitation applies regardless of legal theory (contract, tort, negligence, strict liability).

15. INDEMNITY

You agree to indemnify, defend, and hold harmless the App Provider, directors, employees, agents, partners, licensors, and affiliates from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use or misuse of the App, your violation of this Agreement, your violation of any law, your infringement of third-party rights, and disputes between You and Third Party Providers.

16. TERMINATION

This Agreement is effective until terminated. We may suspend or terminate your access at any time, with or without notice, if You violate this Agreement, We suspect fraud or abuse, or App operation must be stopped for legal or security reasons.

Upon termination, You must stop using the App. Clauses relating to intellectual property, limitation of liability, indemnity, and governing law will survive termination.

17. FORCE MAJEURE

We shall not be liable for any delay or interruption caused by events beyond our reasonable control, including but not limited to natural disasters, power or network outages, government restrictions, strikes or labor disputes, cyberattacks or system failures, and pandemics or epidemics.

18. GOVERNING LAW & JURISDICTION (OMAN)

This Agreement shall be governed by and interpreted in accordance with the laws of the Sultanate of Oman. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Sultanate of Oman.

19. APPLE APP STORE & GOOGLE PLAY DISCLAIMERS

19.1 Apple App Store (iOS) Disclaimer

You acknowledge that this Agreement is between You and the App Provider, not Apple Inc. Apple is not responsible for the App, its content, support, or services. Apple has no obligation to provide maintenance or support. In case of App failure, You may notify Apple and Apple may refund the purchase price (if applicable), but Apple has no further obligations. Apple is a third-party beneficiary of this Agreement and may enforce it.

19.2 Google Play Disclaimer

You acknowledge that Google is not responsible for the App, content, services, or Third Party Providers. Payments handled via Google Play (if any) are governed by Google Play policies. Any disputes related to third-party services remain between You and the vendor/provider.

20. SUBSCRIPTIONS / PAYMENTS (IF APPLICABLE)

If the App provides paid services, subscriptions, or vendor premium features in the future:

• Pricing and billing terms will be displayed clearly before purchase
• Purchases may be processed through Apple App Store or Google Play
• Renewal and cancellation will follow store policies
• Refunds will follow Apple/Google refund policies unless otherwise required by law

(If there are currently no paid services, this clause applies only when introduced.)

21. SEVERABILITY

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.

22. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between You and the App Provider and supersedes prior communications.
